Terms of Service — EREG-Dialer

These Terms govern your access to and use of EREG-Dialer, operated by Elite Real Estate Group.

1. Account

You must be 18+, a licensed real-estate professional (or designated assistant), and authorized to bind your organization. One owner per organization; additional users are "seats" under the organization's subscription.

2. Subscription & billing

• Plans are per-seat. The base subscription includes 1 seat.
• Billed monthly or annually in advance via Stripe.
• 14-day free trial. No card required to start.
• Cancel any time via the customer portal. Cancellation takes effect at the end of the current billing period.

3. Acceptable use

Use of EREG-Dialer is subject to our Acceptable Use Policy. See docs/legal/AUP.md.

4. Compliance

You are responsible for compliance with TCPA, A2P 10DLC, state DNC laws, recording-consent laws, and any other applicable regulation. We provide tools; specific call legality depends on facts we cannot verify.

5. Data

We are the data processor for your tenant data. The DPA addendum covers EU/UK customers and the SCCs apply. We never train AI models on your data.

6. Refunds

Refunds are at our discretion. Submit a request via Settings → Billing → Request a refund. The Refund Policy at docs/legal/Refund-Policy.md governs.

7. Availability & SLA

We target 99.5% uptime for the dialer endpoint. Service credits, if any, are documented in the Refund Policy.

8. Liability

To the maximum extent permitted by law, our liability is limited to fees paid by you in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account for violations of the AUP, non-payment, or required by law.

10. Changes

We may update these Terms with 30 days' notice.

11. Governing law

Delaware, USA.
